Nostalgique LLC Terms of service

 

Welcome to Nostalgique.


Effective Date: June 5, 2025

These Terms of Service (“Terms”) govern your access to and use of the services, website, and offerings (collectively, the “Services”) provided by Nostalgique LLC (“Nostalgique,” “we,” “our,” or “us”), a New York limited liability company. By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our Services.


1. Eligibility & Client Representation

  • Eligibility: Services are available only to individuals aged 21 or older and to legal entities capable of forming binding contracts under New York law.
  • Client Representation: You represent that all information provided is accurate, complete, and current, and agree to update information as necessary.

2. Service Scope & Limitations

  • Service Description: Nostalgique provides luxury lifestyle management and hospitality services, including but not limited to concierge, event planning, home management, and third-party partner services.
  • Geographic Scope: Services are primarily available in select New York City neighborhoods and affluent surrounding areas.
  • Availability: All services are subject to availability, partner capacity, and may be limited by location or other criteria.
  • Third-Party Partners: Some services are fulfilled by third-party partners selected for quality and reliability. Nostalgique is not liable for acts or omissions of third-party providers but will mediate service issues per our quality standards.

3. Memberships, Fees & Payment

  • Membership Requirement: Certain services require an active membership, subject to acceptance and compliance with these Terms.
  • Onboarding: New lifestyle management members will receive a complimentary 3-course dinner for up to 10 guests as a welcome benefit. Onboarding includes an initial consultation to identify client needs, set expectations, and address pain points.
  • Fees: All fees, charges, and payment terms will be disclosed prior to purchase or renewal. Fees are non-refundable unless otherwise stated in writing.
  • Payment Terms: Payment must be made via approved methods. Failure to pay may result in suspension or termination of services.
  • Changes: Nostalgique reserves the right to modify membership tiers, fees, or service offerings with 30 days’ advance notice.

4. Cancellations, Refunds & Termination

  • Cancellations: Members may cancel services or memberships by written notice, subject to any minimum term or notice period specified in their agreement.
  • Refunds: Refunds are only issued in accordance with our published refund policy or as required by law.
  • Termination: Nostalgique may suspend or terminate services for violation of these Terms, non-payment, fraud, or conduct harmful to our reputation or clients. All outstanding fees remain payable.

5. Client Conduct & Responsibilities

  • Conduct: Clients agree to treat all staff, partners, and service providers with respect and professionalism.
  • Use Restrictions: Services may not be used for illegal, abusive, or harmful purposes, nor to facilitate or conceal unlawful conduct.
  • Property Access: Clients are responsible for providing safe access to premises and must notify Nostalgique of any hazards, special conditions, or security requirements.

6. Emergency Response Protocol

  • Red Phone Service: For urgent requests outside normal business hours, clients are provided direct access to the CEO via a dedicated “red phone” line.
  • Backup Channels: In case of technical failure, clients may contact support via email or text.
  • Limitations: Emergency protocol is for urgent, time-sensitive matters only. Abuse of emergency channels may result in restricted access.

7. Partner Services & Liability

  • Partner Selection: Nostalgique partners are selected based on stringent criteria, including insurance (minimum $1M liability), high customer ratings, financial stability, and service reliability.
  • Independent Contractors: Partners are independent contractors, not employees or agents of Nostalgique.
  • Service Quality: Partners are required to meet punctuality, client satisfaction, and consistent execution standards. Quarterly reviews are conducted on financials, response times, and performance.
  • Liability: To the maximum extent permitted by law, Nostalgique is not liable for damages, losses, or injuries caused by third-party partners. Clients agree to pursue claims directly with the responsible provider.
  • Contingency: In the event of partner non-performance, Nostalgique will implement backup service options where feasible.

8. Membership Tiers, Benefits & Exclusivity

  • Founding Member Perks: The first five founding members receive bespoke services, event tickets, additional meal prep weeks, live red phone support, and complimentary car service (subject to availability and as defined in their membership agreement).
  • Exclusive Events: Members may receive invitations to exclusive events (art gallery openings, wine tastings, private concerts, etc.), subject to availability and membership tier.
  • Referral Incentives: Members who refer new clients may receive exclusive event tickets and/or bonus service hours, as detailed in the current referral program.
  • Scarcity & Early Access: Nostalgique reserves the right to limit membership availability and event access to preserve exclusivity.

9. Privacy & Data Security

  • Privacy: Nostalgique collects and processes personal information in accordance with our Privacy Policy.
  • Data Security: Reasonable safeguards are implemented to protect client information; however, no method is 100% secure.
  • Cookies: Our website uses cookies to analyze traffic and optimize user experience.

10. Intellectual Property

  • Ownership: All content, branding, and materials are owned by Nostalgique LLC and protected by copyright, trademark, and other laws.
  • Use: No content may be copied, distributed, or used for commercial purposes without express written consent.

11. Disclaimers & Limitation of Liability

  • No Warranty: Services are provided “as is” and “as available.” Nostalgique disclaims all warranties, express or implied, including fitness for a particular purpose, non-infringement, and merchantability.
  • Limitation: To the fullest extent permitted by law, Nostalgique’s liability for any claim is limited to the amount paid by the client in the 6 months preceding the event giving rise to the claim.
  • Force Majeure: Nostalgique is not liable for delays or failures resulting from causes beyond its reasonable control.

12. Indemnification

You agree to indemnify, defend, and hold harmless Nostalgique, its affiliates, officers, employees, and partners from any claims, losses, liabilities, damages, or costs arising from your use of the Services, violation of these Terms, or infringement of any rights of a third party.

13. Dispute Resolution & Governing Law

  • Governing Law: These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.
  • Dispute Resolution: Any dispute arising under these Terms shall be resolved by binding arbitration in New York County, NY, except for claims eligible for small claims court.
  • Class Action Waiver: All disputes must be brought on an individual basis; class actions are not permitted.

14. Changes to Terms

Nostalgique reserves the right to update these Terms at any time. Revised Terms will be posted on our website with the effective date. Continued use of Services constitutes acceptance of the updated Terms.


15. Miscellaneous

  • Severability: If any provision is found unenforceable, the remainder remains in effect.
  • Entire Agreement: These Terms, together with any signed agreements, constitute the entire agreement between you and Nostalgique.

Nostalgique Fair Usage Policy – Top Tier Memberships

To ensure exceptional service quality and equitable access for all members, Nostalgique maintains the following Fair Usage Policy for our Premier ($35,000) and Elite ($85,000) membership tiers:

1. Service Requests & Response Times

  • Members may submit unlimited service requests; however, requests are subject to availability and prioritized based on urgency and membership tier.
  • Urgent requests (e.g., emergencies, last-minute needs) will be acknowledged within 30 minutes and fulfilled as quickly as possible.
  • Non-urgent requests will be acknowledged within 90 minutes and scheduled according to availability.

2. Scope of Services

  • Membership includes access to all core services (e.g., hospitality, home management, exclusive events, partner offerings) as outlined in your tier benefits.
  • Certain high-demand or resource-intensive services (e.g., private chef events, luxury transport, event planning) may have usage limits or require advance booking, particularly during peak seasons.

3. Fair Use Limits

  • To maintain premium service for all, Nostalgique reserves the right to review usage patterns. Excessive, repeated, or unreasonable requests that significantly exceed typical member usage may be subject to review and adjustment.
  • Members will be notified if their service usage approaches or exceeds fair use thresholds, and may be offered customized solutions or, in rare cases, asked to upgrade or adjust their plan.

4. Event & Partner Service Bookings

  • Complimentary or included services (e.g., event tickets, private dining, car service) are subject to availability and may have annual or per-member allocation caps (details provided in your membership agreement).
  • Additional bookings beyond included allocations may incur standard partner rates or surcharges.

5. Abuse & Good Faith Usage

  • Membership is intended for personal, household, and immediate family use only. Resale, transfer, or commercial use of services is strictly prohibited.
  • Abuse of services (e.g., repeated last-minute cancellations, no-shows, misrepresentation of needs) may result in suspension or modification of membership privileges.

6. Policy Changes

  • Nostalgique reserves the right to update this Fair Usage Policy to ensure optimal member experience. Members will be notified in advance of any significant changes.
