2. Eligibility
- Must be 18+ to RSVP, attend VIP areas, or participate in promotions. Family programming admits minors with a parent/guardian.
- Void where prohibited by law.
A) Tailgate at the Windrose — Event Terms (9:00 AM–10:00 PM)
- Admission & Check‑In
- RSVP is required via our 30‑second Standard or LUXE contact form. No payment is required at the time of form submission unless otherwise stated on the site.
- Photo ID may be required at check‑in. Wristbands or credentials must be worn and are non‑transferable.
- Venue Rules & Conduct
- Follow all venue, fire, safety, and staff instructions. No smoking in prohibited areas; no outside alcohol; no weapons.
- We reserve the right to deny entry or remove any guest for disorderly, unsafe, or disruptive behavior without refund.
- Programming & Changes
- Entertainment, talent, culinary activations, and schedules are subject to change or cancellation due to weather, safety, or operational needs.
- A weather contingency plan may relocate certain activations indoors or under cover.
- Amenities & Complimentary Items
- Complimentary slice/drink/gelato promotions are while supplies last and may require showing a confirmed form submission.
- VIP/LUXE amenities (lounge access, reserved seating, tasting flights) are available only to credentialed VIP/LUXE guests.
- Photography & Media
- By entering, you consent to being photographed/filmed for promotional use by Nostalgique and partners. If you wish to opt out of close‑up media, notify a concierge on arrival.
- Health & Safety
- Do not attend if you feel ill or are under isolation instructions. We may implement health screenings at our discretion.
- Children must be supervised by a responsible adult at all times. Strollers are allowed only in designated areas.
- Liability
- Attendees assume all risks associated with outdoor events. Nostalgique and venue owners are not liable for lost/stolen property or personal injury except where caused by our gross negligence or willful misconduct.
- Refunds/Cancellations
- If an event segment is canceled for reasons beyond our control (e.g., severe weather, force majeure), we may reschedule or offer a comparable experience at our discretion. No cash compensation is guaranteed unless required by law.
B) NY Home Games Attendance — LUXE VIP Exclusive Terms (Select Dates Only)
- Eligibility & Access
- Access is exclusive to active Nostalgique LUXE VIPs (as defined in your membership agreement). Invitations are limited and may require RSVP confirmation.
- Tickets/credentials may be provided by team, stadium, or authorized partners. All third‑party venue policies apply.
- Transportation & Concierge
- Chauffeur service (Dia Limousine or partner) and concierge accompaniment may be included when specified. Pick‑ups are from designated areas only.
- Arrival times are strictly enforced to meet stadium security screening windows.
- Conduct & Stadium Rules
- All stadium rules control (bag policy, prohibited items, code of conduct). Failure to comply may result in denied entry or ejection without refund and may affect future eligibility.
- Resale & Transfers
- Tickets are non‑transferable and not for resale. Any attempted resale or transfer cancels access without refund.
- Changes & Substitutions
- Dates, seating, and inclusions are subject to change due to team or stadium operations. We may substitute tickets of equal or higher face value, adjust hospitality access, or reschedule if necessary.
- Risk & Liability
- You acknowledge the inherent risks of attending live sporting events and agree to stadium liability waivers. Nostalgique’s liability is limited to the maximum extent permitted by law.
C) Super Bowl LX Grand Giveaway — Referral Program (No Cap)
- Overview
- Program Name: Tailgate to the Bowl — Grand Giveaway.
- Objective: Earn points by referring verified RSVPs for Tailgate at the Windrose. No purchase necessary.
- How to Enter
- Complete our RSVP form (Standard/LUXE) to receive your personal referral link/QR. Share with friends to earn points.
- Points
- +3 points: Each unique, valid RSVP completed via your link (name + mobile + consent).
- +1 point: Each referred guest who checks in event day.
- +2 points: One daily social post tagging the event with your link (max +2/day).
- Bonus +5: Each RSVP selecting “LUXE” interest on the form.
- Fraud/duplicates/bots void entries and may result in disqualification.
- Program Period & Leaderboard
- Program runs from [Start date/time ET] to [End date/time ET]. All actions must occur within this window.
- Live leaderboard may be displayed; standings are subject to verification.
- Prizes
- Grand Prize (Top Winner): Private Jet Charter and Chauffeur Service accompanied by a Nostalgique Hospitality Concierge Team to Super Bowl LX in the Bay Area. Includes:
- Private jet charter (or, at Sponsor’s discretion if aviation constraints apply, equivalent private aviation credit, shared‑leg seats, or first‑class commercial flights), chauffeur transfers, hotel/hospitality access, and concierge itinerary management. Approximate retail value (ARV) up to [$XX,XXX].
- Runners‑Up (Top 4): VIP Tailgate perks (Coach’s Corner, chauffeured arrival, tasting flight). ARV up to [$X,XXX] each.
- Weekly Winners: Partner perks/F&B credits. ARV up to [$XXX].
- Prizes are non‑transferable, with no cash alternative. Sponsor may substitute with equal or greater value if needed.
- Winner Selection & Notification
- The highest verified point total at close wins the Grand Prize. Ties: 48‑hour “final sprint” tiebreaker at Sponsor’s discretion.
- Winners notified by SMS/email; must respond within 48 hours or an alternate winner may be selected.
- Travel/Compliance (Grand Prize)
- Travel on Sponsor‑specified dates around Super Bowl LX. Departures from NY‑metro airports (HPN/TEB/FRG) to Bay Area (SFO/OAK/SQL) subject to slot/FBO availability.
- Winner/guest must present valid ID, comply with FBO/security/stadium rules, and sign required documents. Sponsor may modify itinerary for safety, slot controls, or force majeure.
- Taxes & Forms
- Grand Prize winner will receive IRS Form 1099 for ARV; winner is responsible for all taxes/fees.
- Conduct & Fair Play
- Spamming, misleading promotions, or automated/bulk referrals are prohibited. Sponsor may remove points or disqualify at its sole discretion.
- Publicity & Privacy
- By accepting a prize, winners grant Sponsor the right to use name/initial, likeness, and city/state for promotion without additional compensation where lawful.
- Data is processed per our Privacy Policy for program administration and event communication.
D) Reservations, Countdown Timer, and Capacity Controls
- Countdown Timer
- Certain offers or bundles may require completing your reservation within the on‑site countdown timer to secure availability or promotional pricing. When the timer expires, inventory and pricing may change or be released.
- Capacity & Inventory
- All admissions, lounges, tastings, and transportation are capacity‑controlled and first‑come, first‑served, even with RSVP. We may stagger entry times for safety and flow.
- Payment Windows (if/when enabled)
- If a paid upgrade or package is offered, payment must be completed within the on‑site timer window to lock your spot. Unpaid holds automatically release.
E) Transportation, Safety & Compliance
- Transport (Dia Limousine or partner) operates within set call times and ADA pick‑up zones. Guests must follow marshal instructions.
- Alcohol service is 21+ with valid ID. We reserve the right to refuse service.
- Prohibited items follow venue and local regulations. Any illegal activity results in removal and notice to authorities.
F) Disclaimers, Limits, and Force Majeure
- We are not responsible for delays or failures caused by weather, acts of God, labor actions, public safety directives, or third‑party outages (airports, FBOs, stadiums).
- To the fullest extent permitted by law, our total liability to any attendee shall not exceed the amounts actually paid to us for the relevant experience, if any.
G) Changes to Terms
- We may modify these Terms to reflect operational, safety, or legal updates. The “Last updated” date will reflect the latest version.
H) Governing Law & Dispute Resolution
- Governed by the laws of the State of New York. Disputes will be resolved by good‑faith negotiation, then mediation or binding arbitration in Westchester County, NY.

- Insert the countdown timer rule near any time‑boxed reservation modules.
